  • The China – Rare Earths Disputes

    April 9, 2014 - 12:00pm - 2:30pmA few days ago the - after the China-Raw Materials cases two years ago - hotly anticipated WTO dispute settlement panel reports in China – Rare Earths (DS431, 432, 433) were made public. The panel revisited the issue of the availability of GATT Article XX as a justification for China’s violation of its export duty commitment under Paragraph 11.3 of its Accession Protocol. The panel majority determined that Article XX is not available to justify a breach of China’s “WTO-Plus” obligation. In evaluating China’s "conservation" defence, the panel recognized sustainable development needs and objectives in designing a conservation policy but also stressed the requirement that real restrictions on domestic use of natural resources should work together with the export restrictions and that the burden of conservation between foreign and domestic consumers should be distributed in a balanced manner. This edition of "Talking Disputes" discusses the decision and looks at its implications, not least for the use of labelling requirements under the disciplines of the TBT Agreement.
