Central America-EU Agreement: Looking for Senior Trade Law, Competition, Public Procurement and Trade & Sustainable Dev't Experts

WTI Advisors is looking for four experts to work on key aspects of the implementation of the EU-Central America Association Agreement (Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua, Panama) - specifically Competition Law, Procurement Law, Trade & Sustainable Development (incl. Environmental law) and general Int'l Trade Law (= everything else that's in the Agreement).

From the Terms of Reference:

EXPERTS PROFILE & EXPERTISE

We are asked to assemble a team of four experts with - between them - the following indicative expertise:

  • Extensive legal expertise of international trade (WTO) law
  • Extensive knowledge on trade agreements, including the Association Agreement between 
the EU and Central America
  • Specific knowledge on competition legislation, preferably in the Central American 
region
  • Specific knowledge on government procurement legislation, preferably in the Central 
American region
  • Specific knowledge on sustainable development policies and EU trade policy aims and 
objectives
  • Knowledge of Central American and EU politics, political systems and markets, as well 
as legislative and regulatory environment in both Central America and the EU
  • Excellent English and Spanish drafting skills.

The team will have four members:

  • Expert I: Team Leader
  • Expert II: Senior expert on competition policy
  • Expert III: Senior expert on public procurement
  • Expert IV: Senior expert on Sustainable Trade

Expert I: Team Leader

The Team Leader will have the overall responsibility for the coordination and management of the team of experts carrying out the assignment as described in these terms of reference, ensuring: respect for deadlines, quality, consistency and high-standard of outcomes. She/he will be familiar with EU trade agreements and EU external trade policies as well as with Central American regulatory and legislative processes. Moreover, she/he will be particularly responsible for ensuring that a tailored strategy is proposed for each measure identified and described in the analysis. In this regard, the team leader, with the support of the other three experts, will be responsible for identifying trade irritants in pieces of legislation different than competition or government procurement. Based on the research provided by his team members, she/he will conduct an independent analysis on other factors/legislation that influence compliance with the Association Agreement.

Qualification and skills:

  • Education at the level of Master's Degree in law, international trade, economics or other 
relevant fields.

General professional experience:

  • At least 10 years of post-graduate experience in fields related to international trade law and trade agreements.

Specific professional experience:

  • Proven experience in leading and coordinating international teams on at least 3 different assignments, each with a minimum continuous duration of 6 months.
  • A minimum of 5 years of proven work experience linked to the implementation of international trade agreements, out of which preferably 3 years in Latin America.

Expert II: Senior expert on competition policy

The senior expert on competition policy will be responsible for analysing legislation on competition in all six Central American countries with a view to identifying common ground. Moreover, the senior legal expert will provide suggestions and concrete ways forward on how to address the main issues in the regional integration process on competition policy. She/he will have in-depth knowledge on competition law and be familiar with the regulatory and legislative environment in Central America. The assignment might involve an analysis of legislation on related topics such as consumer protection.

Qualification and skills:

  • Education at the level of Master's Degree in law, international trade, economics or other relevant fields.

General professional experience:

  • At least 10 years of post-graduate experience in fields related to international trade law and/or competition law.

Specific professional experience:

  • At least 5 years of specific professional experience in competition law, preferably in the private sector (law firm) in Central America.
  • Additional experience of working with government entities on the implementation of competition law chapters in trade agreements is an asset.

Expert III: Senior expert on public procurement

The senior expert on public procurement will have the responsibility of identifying the main sticking points in national legislation on government procurement with a view to assisting in the development of a single contact point. In this regard, she/he will have the task of analysing each country's legislation on government procurement. She/he will have in-depth knowledge on public procurement as well as be familiar with the regulatory and legislative environment in Central America.

Qualification and skills:

  • Education at the level of Master's Degree in law, international trade, economics or other relevant fields.

General professional experience:

  • At least 10 years of post-graduate experience in fields related to public procurement, and/or international trade law and trade agreements.

Specific professional experience:

  • At least 5 years of specific professional experience in public procurement, preferably in Latin America.
  • Additional experience of working with government entities on the implementation of public procurement chapters in trade agreements is an asset.

Expert IV: Senior Expert on Sustainable Trade

The senior expert on Sustainable Trade will be responsible for identifying and analysing the main issues within the sustainable development chapter of the Agreement. She/he will be familiar with environmental law and policies as well as international standards in the field of sustainable development. Moreover, the Sustainable Trade expert will be familiar with the regulatory and legislative environment in Central America to the extent that she/he is able to identify specific laws and policies in national legislation that support an increased understanding on global value chains linked to green technologies.

Qualification and skills:

  • Education at the level of Master's Degree in law, international trade, economics or other relevant fields.

General professional experience:

  • At least 10 years of post-graduate experience in fields related to international environmental and labout law and/or international trade law and trade agreements.

Specific professional experience:

  • At least 3 years of specific professional experience linked to environmental and labour provisions/chapters in international trade agreements.
  • Any additional experience of working in the field of environmental, labour and sustainable development - including green technologies or renewable energy - in private sector companies in Latin America is an asset.
